1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the KETSHE mobile application and website (the "Service", "KETSHE"). The Service is developed and operated by KATRO TECHNOLOGIES SARL (Democratic Republic of the Congo), for users located in the Democratic Republic of the Congo, and KATRO TECHNOLOGIES LIMITED (United Republic of Tanzania), for users located in the United Republic of Tanzania (together, "KATRO TECHNOLOGIES", "we", "us", the "Company"). For users located in any other country, KATRO TECHNOLOGIES SARL applies by default.

In these Terms, "KETSHE" refers to the application itself; "we", "us", "KATRO TECHNOLOGIES", or "the Company" refers to KATRO TECHNOLOGIES SARL or KATRO TECHNOLOGIES LIMITED, whichever is applicable to you based on your country of residence.

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

KETSHE is a community-driven traffic and road-safety application. The Service is designed for use in the Democratic Republic of the Congo and for use in the United Republic of Tanzania. The Service may be accessible from other countries, but certain features (map coverage, local alerts, local regulatory compliance) may not be available or adapted there.

Core features are available free of charge, for basic functionality and personal use, without registering an account; some features (such as saving Home & Work locations) require registration. Certain additional services, identified as such within the application, may be offered on a paid basis.

3. Eligibility and Account Registration

To register an account, you provide a mobile number, choose a 6-digit PIN, and provide your first name. You are responsible for keeping your PIN confidential and for all activity under your account. You must provide accurate information and may not impersonate another person or maintain more than one account for abusive purposes. You must be legally capable of entering into these Terms under applicable law. See our Privacy Policy, Section 8, regarding the minimum age for the processing of personal data.

4. Acceptable Use

When using the Service, you agree not to:

• Submit false, misleading, or malicious community reports (for example, reporting an accident or hazard that does not exist).
• Attempt to reverse-engineer, decompile, or interfere with the Service or its underlying systems.
• Circumvent or abuse rate limits, subscription allowances, or authentication mechanisms.
• Use the Service for any unlawful purpose or in a way that endangers other road users.

We may investigate and take appropriate action, including suspending or terminating accounts, for violations of this section.

5. Subscriptions, Packages, and Purchases

KETSHE is free to use for its core features and for personal use. Certain additional services (such as higher-volume map, routing, geocoding, or AI usage, or services intended for professional or fleet use) may be offered on a paid basis, or governed by subscription packages with usage allowances. These paid services are identified as such within the Service; the absence of a price indication means the feature is free to use.

You may purchase additional allowance through the Service, or receive an allowance granted by an administrator. Prices and package details are as displayed in the Service at the time of purchase.

A payment gateway is not yet live at the time of writing; purchases are currently processed as described in the Service, and this section will be updated once real payment processing is introduced. Except as required by applicable law, purchased allowances are non-refundable once granted.

6. Community-Submitted Content

When you submit a community report (such as a traffic or safety issue), including any photographs or other content submitted with it, you grant KETSHE a non-exclusive, worldwide, royalty-free license to use, display, and distribute that report — in aggregated or original form — to other users of the Service, for the purpose of operating and improving the Service. You are solely responsible for the accuracy of content you submit.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by KATRO TECHNOLOGIES or its licensors and is protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose — they do not transfer any ownership rights to you.

8. Attribution for Third-Party Use of Maps and Data

If you access KETSHE map tiles, routing, geocoding, or other data services through our API (for example, to build your own website, app, or product), you must keep the KETSHE attribution — including our logo and any accompanying copyright or contributor notice — visible on any map or interface that displays our data. Where our API delivers this attribution automatically (such as within map tile metadata), it is provided for this purpose and forms part of your license to use the Service.

• Not hide, remove, resize below legibility, or otherwise visually obscure the KETSHE attribution or logo.
• Not modify, replace, or misrepresent the attribution in a way that suggests the map or data is not sourced from KETSHE.
• Ensure the attribution remains visible in any embedded, cached, or redistributed view of the map or data.

We may suspend or terminate API access, without notice, for use that does not comply with this section.

9. Disclaimers

The Service, including traffic conditions, routing, and community reports, is provided "as is" and "as available." Traffic and safety information is sourced in part from other users and may be inaccurate, incomplete, or delayed. The Service is not a substitute for safe driving judgment, official traffic signage, or emergency services, and must not be relied upon as such. Always comply with local traffic laws and exercise your own judgment while driving.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KATRO TECHNOLOGIES will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including damages resulting from inaccurate traffic or community-reported information. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold KATRO TECHNOLOGIES harmless from claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or used the Service in a way that risks harm to others or to the Service itself.

13. Governing Law

These Terms are governed by the laws of the Democratic Republic of the Congo for users located in the Democratic Republic of the Congo, and by the laws of the United Republic of Tanzania for users located in the United Republic of Tanzania. For users located in any other country, the laws of the Democratic Republic of the Congo apply by default, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "last updated" date above and, where appropriate, notify you through the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Description du Service

KETSHE est une application communautaire d'information routière et de sécurité routière. Le Service est conçu pour un usage en République Démocratique du Congo et pour un usage en République-Unie de Tanzanie. Le Service peut être accessible depuis d'autres pays, mais certaines fonctionnalités (couverture cartographique, alertes locales, conformité réglementaire locale) peuvent ne pas y être disponibles ou adaptées.

Les fonctionnalités de base sont accessibles gratuitement, pour un usage de base et personnel, sans création de compte ; certaines fonctionnalités (comme l'enregistrement des lieux Domicile & Travail) nécessitent une inscription. Certains services additionnels, identifiés comme tels dans l'application, peuvent être proposés sous forme payante.

3. Éligibilité et Inscription au Compte

Pour créer un compte, vous devez fournir un numéro de téléphone mobile, choisir un code PIN à 6 chiffres, et indiquer votre prénom. Vous êtes responsable de la confidentialité de votre code PIN et de toute activité effectuée sous votre compte. Vous devez fournir des informations exactes et ne pouvez pas usurper l'identité d'une autre personne ni détenir plusieurs comptes à des fins abusives. Vous devez avoir la capacité juridique de conclure les présentes Conditions selon le droit applicable. Voir notre Politique de Confidentialité, Section 8, concernant l'âge minimum applicable au traitement des données personnelles.

4. Utilisation Acceptable

En utilisant le Service, vous vous engagez à ne pas :

• Soumettre des signalements communautaires faux, trompeurs ou malveillants (par exemple, signaler un accident ou un danger qui n'existe pas).
• Tenter de désassembler, décompiler ou interférer avec le Service ou ses systèmes sous-jacents.
• Contourner ou abuser des limites de fréquence d'utilisation, des quotas d'abonnement ou des mécanismes d'authentification.
• Utiliser le Service à des fins illégales ou d'une manière mettant en danger d'autres usagers de la route.

Nous pouvons enquêter et prendre les mesures appropriées, y compris la suspension ou la résiliation de comptes, en cas de violation de la présente section.

5. Abonnements, Forfaits et Achats

KETSHE est gratuit pour ses fonctionnalités de base et pour un usage personnel. Certains services additionnels (tels qu'un usage à volume élevé pour la cartographie, le routage, le géocodage ou l'IA, ou des services destinés à un usage professionnel ou de flotte) peuvent être proposés sous forme payante, ou régis par des forfaits d'abonnement avec des quotas d'utilisation. Ces services payants sont identifiés comme tels dans le Service ; l'absence d'indication de prix signifie que la fonctionnalité est gratuite.

Vous pouvez acheter un quota supplémentaire via le Service, ou recevoir un quota accordé par un administrateur. Les prix et détails des forfaits sont ceux affichés dans le Service au moment de l'achat.

Une passerelle de paiement n'est pas encore active au moment de la rédaction ; les achats sont actuellement traités tel que décrit dans le Service, et cette section sera mise à jour lors de l'introduction d'un traitement de paiement réel. Sauf disposition contraire de la loi applicable, les quotas achetés ne sont pas remboursables une fois accordés.

6. Contenu Soumis par la Communauté

Lorsque vous soumettez un signalement communautaire (tel qu'un problème de circulation ou de sécurité), y compris toute photographie ou autre contenu soumis avec celui-ci, vous accordez à KETSHE une licence non exclusive, mondiale et gratuite pour utiliser, afficher et distribuer ce signalement — sous forme agrégée ou originale — aux autres utilisateurs du Service, dans le but d'exploiter et d'améliorer le Service. Vous êtes seul responsable de l'exactitude du contenu que vous soumettez.

7. Propriété Intellectuelle

Le Service, y compris ses logiciels, sa conception et ses marques, est la propriété de KATRO TECHNOLOGIES ou de ses concédants de licence, et est protégé par les lois applicables en matière de propriété intellectuelle. Les présentes Conditions vous accordent une licence limitée, non exclusive et non transférable d'utiliser le Service pour sa finalité prévue — elles ne transfèrent aucun droit de propriété.

8. Attribution pour l'Utilisation par des Tiers des Cartes et Données

Si vous accédez aux tuiles cartographiques, au routage, au géocodage ou à d'autres services de données de KETSHE via notre API (par exemple, pour développer votre propre site web, application ou produit), vous devez conserver visible l'attribution KETSHE — y compris notre logo et toute mention de droits d'auteur ou de contributeurs — sur toute carte ou interface affichant nos données. Lorsque notre API fournit automatiquement cette attribution (par exemple dans les métadonnées des tuiles cartographiques), celle-ci est fournie à cette fin et fait partie intégrante de votre licence d'utilisation du Service.

• Ne pas masquer, retirer, réduire en dessous du seuil de lisibilité, ou autrement obscurcir visuellement l'attribution ou le logo KETSHE.
• Ne pas modifier, remplacer ou dénaturer l'attribution d'une manière suggérant que la carte ou les données ne proviennent pas de KETSHE.
• Veiller à ce que l'attribution reste visible dans toute vue intégrée, mise en cache ou redistribuée de la carte ou des données.

Nous pouvons suspendre ou résilier l'accès à l'API, sans préavis, en cas d'utilisation non conforme à la présente section.

9. Avertissements

Le Service, y compris les conditions de circulation, le routage et les signalements communautaires, est fourni « tel quel » et « selon disponibilité ». Les informations de circulation et de sécurité proviennent en partie d'autres utilisateurs et peuvent être inexactes, incomplètes ou différées. Le Service ne remplace pas le jugement de conduite prudente, la signalisation routière officielle ou les services d'urgence, et ne doit pas être utilisé comme tel. Respectez toujours le code de la route local et exercez votre propre jugement en conduisant.

10. Limitation de Responsabilité

Dans toute la mesure permise par le droit applicable, KATRO TECHNOLOGIES ne pourra être tenue responsable de dommages indirects, accessoires ou consécutifs découlant de votre utilisation ou impossibilité d'utiliser le Service, y compris les dommages résultant d'informations de circulation ou de signalements communautaires inexacts. Rien dans les présentes Conditions ne limite une responsabilité qui ne peut être limitée en vertu du droit applicable.

11. Indemnisation

Vous acceptez d'indemniser et de dégager KATRO TECHNOLOGIES de toute responsabilité en cas de réclamations, dommages ou frais découlant de votre violation des présentes Conditions ou d'une mauvaise utilisation du Service.

12. Résiliation

Vous pouvez cesser d'utiliser le Service et supprimer votre compte à tout moment. Nous pouvons suspendre ou résilier votre accès au Service, avec ou sans préavis, si nous estimons raisonnablement que vous avez violé les présentes Conditions ou utilisé le Service d'une manière risquant de nuire à autrui ou au Service lui-même.

13. Droit Applicable

Les présentes Conditions sont régies par le droit de la République Démocratique du Congo pour les utilisateurs situés en République Démocratique du Congo, et par le droit de la République-Unie de Tanzanie pour les utilisateurs situés en République-Unie de Tanzanie. Pour les utilisateurs situés dans tout autre pays, le droit de la République Démocratique du Congo s'applique par défaut, sans égard aux principes de conflit de lois.

14. Modifications des Présentes Conditions

Nous pouvons modifier les présentes Conditions de temps à autre. En cas de modification substantielle, nous mettrons à jour la date de « dernière mise à jour » ci-dessus et, le cas échéant, vous en informerons via l'application. La poursuite de l'utilisation du Service après l'entrée en vigueur des modifications vaut acceptation des Conditions mises à jour.

Masharti na Vigezo haya ("Masharti") yanasimamia matumizi yako ya programu ya simu na tovuti ya KETSHE ("Huduma", "KETSHE"). 2. Maelezo ya Huduma

KETSHE ni programu ya taarifa za trafiki na usalama barabarani inayotegemea jamii. Huduma hii imeundwa kwa matumizi katika Jamhuri ya Kidemokrasia ya Kongo na kwa matumizi katika Jamhuri ya Muungano wa Tanzania. Huduma inaweza kufikiwa kutoka nchi nyingine, lakini baadhi ya vipengele (upeo wa ramani, arifa za eneo, uzingatiaji wa sheria za eneo husika) huenda visipatikane au visifae huko.

Vipengele vya msingi vinapatikana bila malipo, kwa matumizi ya kimsingi na ya kibinafsi, bila kujisajili kwa akaunti; baadhi ya vipengele (kama vile kuhifadhi maeneo ya Nyumbani na Kazini) vinahitaji usajili. Huduma fulani za ziada, zilizoainishwa hivyo ndani ya programu, zinaweza kutolewa kwa malipo.

3. Sifa za Kustahiki na Usajili wa Akaunti

Ili kujisajili kwa akaunti, unatoa nambari ya simu ya mkononi, kuchagua PIN ya tarakimu 6, na kutoa jina lako la kwanza. Wewe ndiye unayewajibika kuhifadhi usiri wa PIN yako na shughuli zote chini ya akaunti yako. Lazima utoe taarifa sahihi na usijifanye kuwa mtu mwingine wala kuwa na akaunti zaidi ya moja kwa madhumuni mabaya. Lazima uwe na uwezo wa kisheria wa kuingia katika Masharti haya kwa mujibu wa sheria husika. 4. Matumizi Yanayokubalika

Unapotumia Huduma, unakubali kutofanya yafuatayo:

• Kutuma taarifa za uongo, za kupotosha, au za nia mbaya kutoka kwa jamii (kwa mfano, kuripoti ajali au hatari isiyokuwepo).
• Kujaribu kutenganisha, kufungua msimbo, au kuingilia Huduma au mifumo yake ya ndani.
• Kukwepa au kutumia vibaya vikomo vya kiwango, viwango vya usajili, au taratibu za uthibitishaji.
• Kutumia Huduma kwa madhumuni yasiyo halali au kwa namna inayoweka hatarini watumiaji wengine wa barabara.

Tunaweza kuchunguza na kuchukua hatua stahiki, ikiwa ni pamoja na kusimamisha au kufuta akaunti, kwa ukiukaji wa kifungu hiki.

5. Usajili, Vifurushi, na Ununuzi

KETSHE ni bure kwa vipengele vyake vya msingi na kwa matumizi ya kibinafsi. Huduma fulani za ziada (kama matumizi makubwa ya ramani, uongozaji njia, utambuzi wa maeneo, au akili bandia, au huduma zinazolengwa kwa matumizi ya kikazi au ya meli za magari) zinaweza kutolewa kwa malipo, au kusimamiwa na vifurushi vya usajili vyenye viwango vya matumizi. Huduma hizi za malipo zinaainishwa hivyo ndani ya Huduma; kutokuwepo kwa bei kunamaanisha kipengele hicho ni bure.

Unaweza kununua kiwango cha ziada kupitia Huduma, au kupokea kiwango kilichotolewa na msimamizi. Bei na maelezo ya vifurushi ni kama vinavyoonyeshwa ndani ya Huduma wakati wa ununuzi.

Mfumo wa malipo bado haujaanzishwa rasmi wakati wa kuandika hii; ununuzi kwa sasa unafanywa kama ilivyoelezwa ndani ya Huduma, na kifungu hiki kitasasishwa mara mfumo halisi wa uchakataji wa malipo utakapoanzishwa. Isipokuwa inavyotakiwa na sheria husika, viwango vilivyonunuliwa haviwezi kurejeshwa mara vinapotolewa.

6. Maudhui Yanayotumwa na Jamii

Unapotuma taarifa ya jamii (kama tatizo la trafiki au usalama), ikiwemo picha au maudhui mengine yaliyotumwa pamoja nayo, unaipa KETSHE leseni isiyo ya kipekee, ya kimataifa, na isiyo na malipo ya kutumia, kuonyesha, na kusambaza taarifa hiyo — kwa muundo wa pamoja au wa asili — kwa watumiaji wengine wa Huduma, kwa madhumuni ya kuendesha na kuboresha Huduma. Wewe pekee ndiye unayewajibika kwa usahihi wa maudhui unayotuma.

7. Haki Miliki

Huduma, ikiwemo programu zake, muundo, na alama za biashara, ni mali ya KATRO TECHNOLOGIES au watoa leseni wake, na inalindwa na sheria husika za haki miliki. Masharti haya yanakupa leseni finyu, isiyo ya kipekee, na isiyoweza kuhamishwa ya kutumia Huduma kwa madhumuni yake yaliyokusudiwa — hayahamishi haki yoyote ya umiliki kwako.

8. Utambuzi wa Matumizi ya Ramani na Data na Wahusika Wengine

Ukifikia vigae vya ramani vya KETSHE, uongozaji njia, utambuzi wa maeneo, au huduma nyingine za data kupitia API yetu (kwa mfano, kujenga tovuti, programu, au bidhaa yako mwenyewe), lazima uhifadhi utambuzi wa KETSHE ukiwa unaonekana — ikiwemo nembo yetu na taarifa yoyote ya hakimiliki au ya wachangiaji — kwenye ramani au kiolesura chochote kinachoonyesha data yetu. Pale ambapo API yetu inatoa utambuzi huu kiotomatiki (kama ndani ya metadata ya vigae vya ramani), unatolewa kwa madhumuni haya na ni sehemu ya leseni yako ya kutumia Huduma.

• Usifiche, kuondoa, kupunguza chini ya kiwango cha kusomeka, au vinginevyo kuficha kwa macho utambuzi au nembo ya KETSHE.
• Usibadilishe, kubadilisha, au kupotosha utambuzi kwa namna inayopendekeza kuwa ramani au data haitokani na KETSHE.
• Hakikisha utambuzi unabaki kuonekana katika mwonekano wowote uliojumuishwa, uliohifadhiwa muda, au uliosambazwa tena wa ramani au data.

Tunaweza kusimamisha au kufuta ufikiaji wa API, bila taarifa, kwa matumizi yasiyozingatia kifungu hiki.

9. Kanusho

Huduma, ikiwemo hali za trafiki, uongozaji njia, na taarifa za jamii, inatolewa "kama ilivyo" na "kulingana na upatikanaji". Taarifa za trafiki na usalama zinatoka sehemu kwa watumiaji wengine na huenda zisiwe sahihi, kamili, au za wakati. Huduma si mbadala wa uamuzi wa uendeshaji salama, alama rasmi za barabarani, au huduma za dharura, na haipaswi kutegemewa kama hivyo. Zingatia daima sheria za trafiki za eneo lako na tumia busara yako mwenyewe unapoendesha.

10. Ukomo wa Dhima

Kwa kadiri inavyoruhusiwa na sheria husika, KATRO TECHNOLOGIES haitawajibika kwa hasara zozote zisizo za moja kwa moja, za bahati mbaya, au zinazotokana na matumizi yako, au kutoweza kutumia, Huduma, ikiwemo hasara zinazotokana na taarifa zisizo sahihi za trafiki au za jamii. Hakuna kitu katika Masharti haya kinachopunguza dhima ambayo haiwezi kupunguzwa kwa mujibu wa sheria husika.

11. Fidia

Unakubali kuilinda na kuiepusha KATRO TECHNOLOGIES na madai, hasara, au gharama zinazotokana na ukiukaji wako wa Masharti haya au matumizi mabaya ya Huduma.

12. Kusitishwa

Unaweza kuacha kutumia Huduma na kufuta akaunti yako wakati wowote. Tunaweza kusimamisha au kufuta ufikiaji wako wa Huduma, kwa au bila taarifa, ikiwa tunaamini kwa busara kuwa umekiuka Masharti haya au kutumia Huduma kwa namna inayohatarisha wengine au Huduma yenyewe.

13. Sheria Inayotumika

Masharti haya yanasimamiwa na sheria za Jamhuri ya Kidemokrasia ya Kongo kwa watumiaji walioko Jamhuri ya Kidemokrasia ya Kongo, na sheria za Jamhuri ya Muungano wa Tanzania kwa watumiaji walioko Jamhuri ya Muungano wa Tanzania. Kwa watumiaji walioko nchi nyingine yoyote, sheria za Jamhuri ya Kidemokrasia ya Kongo zitatumika kwa default, bila kuzingatia kanuni za mgongano wa sheria.

14. Mabadiliko ya Masharti Haya

Tunaweza kusasisha Masharti haya mara kwa mara. Tukifanya mabadiliko makubwa, tutasasisha tarehe ya "ilisasishwa mwisho" hapo juu na, inapofaa, kukujulisha kupitia programu. Kuendelea kutumia Huduma baada ya mabadiliko kuanza kutumika kunamaanisha kukubali Masharti yaliyosasishwa.
