1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the KETSHE mobile app and website (the "Service"), operated by KETSHE ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

KETSHE is a community-driven traffic and road-safety application for the Democratic Republic of the Congo and Tanzania, providing live traffic conditions, navigation, community-reported road issues, and security alerts. Core features are available without registering an account; some features (such as saving Home & Work locations or purchasing additional usage) require registration.

3. Eligibility and Account Registration

To register an account, you provide a mobile number, choose a 6-digit PIN, and provide your first name. You are responsible for keeping your PIN confidential and for all activity under your account. You must provide accurate information and may not impersonate another person or maintain more than one account for abusive purposes. You must be legally capable of entering into these Terms under applicable law.

4. Acceptable Use

When using the Service, you agree not to:

• Submit false, misleading, or malicious community reports (for example, reporting an accident or hazard that does not exist).
• Attempt to reverse-engineer, decompile, or interfere with the Service or its underlying systems.
• Circumvent or abuse rate limits, subscription allowances, or authentication mechanisms.
• Use the Service for any unlawful purpose or in a way that endangers other road users.

We may investigate and take appropriate action, including suspending or terminating accounts, for violations of this section.

5. Subscriptions, Packages, and Purchases

Certain services (such as higher-volume map, routing, geocoding, or AI usage) are governed by subscription packages with usage allowances. You may purchase additional allowance through the Service, or receive an allowance granted by an administrator. Prices and package details are as displayed in the Service at the time of purchase.

A payment gateway is not yet live at the time of writing; purchases are currently processed as described in the Service, and this section will be updated once real payment processing is introduced. Except as required by applicable law, purchased allowances are non-refundable once granted.

6. Community-Submitted Content

When you submit a community report (such as a traffic or safety issue), you grant KETSHE a non-exclusive, worldwide, royalty-free license to use, display, and distribute that report — in aggregated or original form — to other users of the Service, for the purpose of operating and improving the Service. You are solely responsible for the accuracy of content you submit.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by KETSHE or its licensors and is protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose — they do not transfer any ownership rights to you.

8. Attribution for Third-Party Use of Maps and Data

If you access KETSHE map tiles, routing, geocoding, or other data services through our API (for example, to build your own website, app, or product), you must keep the KETSHE attribution — including our logo and any accompanying copyright or contributor notice — visible on any map or interface that displays our data. Where our API delivers this attribution automatically (such as within map tile metadata), it is provided for this purpose and forms part of your license to use the Service.

• Not hide, remove, resize below legibility, or otherwise visually obscure the KETSHE attribution or logo.
• Not modify, replace, or misrepresent the attribution in a way that suggests the map or data is not sourced from KETSHE.
• Ensure the attribution remains visible in any embedded, cached, or redistributed view of the map or data.

We may suspend or terminate API access, without notice, for use that does not comply with this section.

9. Disclaimers

The Service, including traffic conditions, routing, and community reports, is provided "as is" and "as available." Traffic and safety information is sourced in part from other users and may be inaccurate, incomplete, or delayed. The Service is not a substitute for safe driving judgment, official traffic signage, or emergency services, and must not be relied upon as such. Always comply with local traffic laws and exercise your own judgment while driving.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KETSHE will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including damages resulting from inaccurate traffic or community-reported information. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold KETSHE harmless from claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or used the Service in a way that risks harm to others or to the Service itself.

13. Governing Law

These Terms are governed by the laws of the Democratic Republic of the Congo, without regard to conflict-of-law principles, unless otherwise required by applicable local law in your country of residence. 14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "last updated" date above and, where appropriate, notify you through the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Description du Service

KETSHE est une application communautaire d'information routière et de sécurité routière pour la République démocratique du Congo et la Tanzanie, fournissant des conditions de circulation en temps réel, une navigation, des incidents routiers signalés par la communauté et des alertes de sécurité. Les fonctionnalités principales sont accessibles sans créer de compte ; certaines fonctionnalités (comme l'enregistrement des lieux Domicile/Travail ou l'achat d'utilisation supplémentaire) nécessitent une inscription.

3. Éligibilité et inscription du compte

Pour créer un compte, vous fournissez un numéro de mobile, choisissez un code PIN à 6 chiffres, et indiquez votre prénom. Vous êtes responsable de la confidentialité de votre PIN et de toute activité effectuée sous votre compte. Vous devez fournir des informations exactes et ne pouvez pas usurper l'identité d'une autre personne ni détenir plusieurs comptes à des fins abusives. Vous devez avoir la capacité juridique de conclure les présentes Conditions selon le droit applicable.

4. Utilisation autorisée

En utilisant le Service, vous acceptez de ne pas :

• Soumettre des signalements communautaires faux, trompeurs ou malveillants (par exemple, signaler un accident ou un danger inexistant).
• Tenter de rétro-concevoir, décompiler ou perturber le Service ou ses systèmes sous-jacents.
• Contourner ou abuser des limites de débit, des allocations d'abonnement ou des mécanismes d'authentification.
• Utiliser le Service à des fins illégales ou d'une manière mettant en danger d'autres usagers de la route.

Nous pouvons enquêter et prendre les mesures appropriées, y compris la suspension ou la résiliation de comptes, en cas de violation de cette section.

5. Abonnements, forfaits et achats

Certains services (comme un usage accru de cartes, d'itinéraires, de géocodage, ou d'intelligence artificielle) sont régis par des forfaits d'abonnement avec des allocations d'utilisation. Vous pouvez acheter une allocation supplémentaire via le Service, ou recevoir une allocation accordée par un administrateur. Les prix et détails des forfaits sont ceux affichés dans le Service au moment de l'achat.

Une passerelle de paiement n'est pas encore en service au moment de la rédaction ; les achats sont actuellement traités comme décrit dans le Service, et cette section sera mise à jour une fois qu'un traitement de paiement réel sera introduit. Sauf disposition contraire du droit applicable, les allocations achetées ne sont pas remboursables une fois accordées.

6. Contenu soumis par la communauté

Lorsque vous soumettez un signalement communautaire (comme un incident de circulation ou de sécurité), vous accordez à KETSHE une licence non exclusive, mondiale et sans redevance pour utiliser, afficher et distribuer ce signalement — sous forme agrégée ou originale — aux autres utilisateurs du Service, aux fins d'exploitation et d'amélioration du Service. Vous êtes seul responsable de l'exactitude du contenu que vous soumettez.

7. Propriété intellectuelle

Le Service, y compris ses logiciels, sa conception et ses marques, est la propriété de KETSHE ou de ses concédants et est protégé par les lois applicables en matière de propriété intellectuelle. Les présentes Conditions vous accordent une licence limitée, non exclusive et non transférable pour utiliser le Service aux fins prévues — elles ne vous transfèrent aucun droit de propriété.

8. Attribution pour l'utilisation des cartes et données par des tiers

Si vous accédez aux tuiles cartographiques, à l'itinéraire, au géocodage ou à d'autres services de données de KETSHE via notre API (par exemple, pour créer votre propre site web, application ou produit), vous devez conserver visible l'attribution KETSHE — y compris notre logo et toute mention de droits d'auteur ou de contributeurs qui l'accompagne — sur toute carte ou interface affichant nos données. Lorsque notre API fournit cette attribution automatiquement (par exemple dans les métadonnées des tuiles cartographiques), elle est fournie à cette fin et fait partie intégrante de votre licence d'utilisation du Service.

• Ne pas masquer, supprimer, réduire en dessous du seuil de lisibilité, ni obscurcir visuellement l'attribution ou le logo KETSHE.

Nous pouvons suspendre ou résilier l'accès à l'API, sans préavis, en cas d'utilisation non conforme à cette section.

9. Avertissements

Le Service, y compris les conditions de circulation, la navigation et les signalements communautaires, est fourni « tel quel » et « selon disponibilité ». Les informations de circulation et de sécurité proviennent en partie d'autres utilisateurs et peuvent être inexactes, incomplètes ou différées. Le Service ne remplace pas le jugement nécessaire à une conduite sûre, la signalisation routière officielle, ou les services d'urgence, et ne doit pas être utilisé comme tel. Respectez toujours le code de la route local et faites preuve de votre propre jugement en conduisant.

10. Limitation de responsabilité

Dans toute la mesure permise par le droit applicable, KETSHE ne sera pas responsable des dommages indirects, accessoires ou consécutifs résultant de votre utilisation, ou de votre incapacité à utiliser, le Service, y compris les dommages résultant d'informations de circulation ou de signalements communautaires inexacts. Rien dans les présentes Conditions ne limite une responsabilité qui ne peut être limitée en vertu du droit applicable.

11. Indemnisation

Vous acceptez d'indemniser et de dégager KETSHE de toute responsabilité concernant les réclamations, dommages ou frais résultant de votre violation des présentes Conditions ou d'une mauvaise utilisation du Service.

12. Résiliation

Vous pouvez cesser d'utiliser le Service et supprimer votre compte à tout moment. Nous pouvons suspendre ou résilier votre accès au Service, avec ou sans préavis, si nous estimons raisonnablement que vous avez violé les présentes Conditions ou utilisé le Service d'une manière risquant de nuire à autrui ou au Service lui-même.

13. Droit applicable

Les présentes Conditions sont régies par le droit de la République démocratique du Congo, sans égard aux principes de conflit de lois, sauf disposition contraire exigée par le droit local applicable dans votre pays de résidence. 14. Modifications des présentes Conditions

Nous pouvons mettre à jour ces Conditions de temps à autre. 1. Ukubalifu wa Masharti

Vigezo na Masharti haya ("Masharti") yanasimamia matumizi yako ya programu ya simu na tovuti ya KETSHE ("Huduma"), inayoendeshwa na KETSHE ("sisi"). Kwa kutumia Huduma, unakubali Masharti haya. Kama hukubaliani, usitumie Huduma.

2. Maelezo ya Huduma

KETSHE ni programu ya jamii ya taarifa za barabara na usalama barabarani kwa ajili ya Jamhuri ya Kidemokrasia ya Kongo na Tanzania, inayotoa hali za trafiki za papo hapo, uongozaji njia, matatizo ya barabarani yaliyoripotiwa na jamii, na tahadhari za usalama. Vipengele vikuu vinapatikana bila kujisajili; baadhi ya vipengele (kama kuhifadhi mahali pa Nyumbani/Kazini au kununua matumizi ya ziada) vinahitaji usajili.

3. Ustahiki na Usajili wa Akaunti

Ili kujisajili akaunti, unatoa namba ya simu, kuchagua PIN ya tarakimu 6, na kutoa jina lako la kwanza. Unawajibika kutunza PIN yako kwa siri na kwa shughuli zote chini ya akaunti yako. Lazima utoe taarifa sahihi na huwezi kujifanya mtu mwingine au kumiliki akaunti zaidi ya moja kwa madhumuni ya unyanyasaji. Lazima uwe na uwezo wa kisheria wa kuingia katika Masharti haya kulingana na sheria zinazotumika.

4. Matumizi Yanayokubalika

Unapotumia Huduma, unakubali kutofanya yafuatayo:

• Kuwasilisha ripoti za jamii za uwongo, za kupotosha, au za nia mbaya (mfano, kuripoti ajali au hatari isiyokuwepo).
• Kujaribu kuchambua kinyume, kufungua msimbo, au kuingilia Huduma au mifumo yake ya msingi.
• Kukwepa au kutumia vibaya vikomo vya kiwango, mgao wa usajili, au mifumo ya uthibitishaji.
• Kutumia Huduma kwa madhumuni yasiyo halali au kwa namna inayohatarisha watumiaji wengine wa barabara.

Tunaweza kuchunguza na kuchukua hatua zinazofaa, ikiwemo kusitisha au kufuta akaunti, kwa ukiukaji wa kifungu hiki.

5. Usajili, Vifurushi, na Manunuzi

Huduma fulani (kama matumizi makubwa ya ramani, uongozaji njia, utafutaji wa maeneo, au akili bandia) zinasimamiwa na vifurushi vya usajili vyenye mgao wa matumizi. Unaweza kununua mgao wa ziada kupitia Huduma, au kupokea mgao uliotolewa na msimamizi. Bei na maelezo ya vifurushi ni kama yanavyoonyeshwa katika Huduma wakati wa ununuzi.

Njia ya malipo bado haijaanza kutumika wakati wa uandishi huu; manunuzi kwa sasa yanashughulikiwa kama ilivyoelezwa katika Huduma, na kifungu hiki kitasasishwa mara tu uchakataji halisi wa malipo utakapoanzishwa. Isipokuwa sheria inayotumika ihitaji vinginevyo, mgao ulionunuliwa hauwezi kurejeshwa mara ukishatolewa.

6. Maudhui Yanayowasilishwa na Jamii

Unapowasilisha ripoti ya jamii (kama tatizo la trafiki au usalama), unaipa KETSHE leseni isiyo ya kipekee, ya kimataifa, isiyo na malipo ya mrabaha kutumia, kuonyesha, na kusambaza ripoti hiyo — katika hali iliyounganishwa au ya asili — kwa watumiaji wengine wa Huduma, kwa madhumuni ya kuendesha na kuboresha Huduma. Wewe pekee unawajibika kwa usahihi wa maudhui unayowasilisha.

7. Haki Miliki

Huduma, ikiwemo programu yake, muundo, na alama za biashara, inamilikiwa na KETSHE au watoa leseni wake na inalindwa na sheria za haki miliki zinazotumika. Masharti haya yanakupa leseni ndogo, isiyo ya kipekee, isiyohamishika ya kutumia Huduma kwa madhumuni yaliyokusudiwa — hayakuhamishii haki yoyote ya umiliki.

8. Utambulisho kwa Matumizi ya Ramani na Data na Wahusika Wengine

Iwapo unatumia vigae vya ramani (map tiles), uongozaji njia, utafutaji wa maeneo, au huduma nyingine za data za KETSHE kupitia API yetu (kwa mfano, kujenga tovuti, programu, au bidhaa yako mwenyewe), lazima uweke utambulisho wa KETSHE — ikiwemo nembo yetu na taarifa yoyote ya hakimiliki au wachangiaji inayoambatana nayo — inayoonekana kwenye ramani au kiolesura chochote kinachoonyesha data yetu. Pale ambapo API yetu inatoa utambulisho huo kiotomatiki (kwa mfano ndani ya metadata ya vigae vya ramani), unatolewa kwa madhumuni haya na ni sehemu ya leseni yako ya kutumia Huduma.

• Usifiche, usiondoe, usipunguze chini ya kiwango cha kusomeka, au kuficha kwa namna nyingine utambulisho au nembo ya KETSHE.
• Usibadilishe, usibadilishe mahali, au kupotosha utambulisho kwa namna inayodokeza kuwa ramani au data haitoki KETSHE.
• Hakikisha utambulisho unabaki kuonekana katika mwonekano wowote uliopachikwa, uliohifadhiwa muda, au uliosambazwa tena wa ramani au data.

Tunaweza kusitisha au kufuta ufikiaji wa API, bila taarifa, kwa matumizi yasiyofuata kifungu hiki.

9. Kanusho

Huduma, ikiwemo hali za trafiki, uongozaji njia, na ripoti za jamii, inatolewa "kama ilivyo" na "kulingana na upatikanaji". Taarifa za trafiki na usalama zinatokana kwa sehemu na watumiaji wengine na huenda zisiwe sahihi, kamili, au za wakati. Huduma si mbadala wa uamuzi wa uendeshaji salama, alama rasmi za barabarani, au huduma za dharura, na haipaswi kutegemewa kama hivyo. Daima zingatia sheria za trafiki za eneo lako na tumia uamuzi wako mwenyewe unapoendesha.

10. Kikomo cha Dhima

Kwa kiwango cha juu kinachoruhusiwa na sheria zinazotumika, KETSHE haitawajibika kwa uharibifu wowote usio wa moja kwa moja, wa bahati mbaya, au unaotokana na matumizi yako, au kutoweza kutumia, Huduma, ikiwemo uharibifu unaotokana na taarifa zisizo sahihi za trafiki au za jamii. Hakuna kitu katika Masharti haya kinachopunguza dhima isiyoweza kupunguzwa chini ya sheria zinazotumika.

11. Fidia

Unakubali kuifidia na kuiepusha KETSHE na madai, uharibifu, au gharama zinazotokana na ukiukaji wako wa Masharti haya au matumizi mabaya ya Huduma.

12. Usitishaji

Unaweza kuacha kutumia Huduma na kufuta akaunti yako wakati wowote. Tunaweza kusitisha au kufuta ufikiaji wako wa Huduma, kwa taarifa au bila taarifa, endapo tuna sababu za kutosha kuamini umekiuka Masharti haya au umetumia Huduma kwa namna inayohatarisha wengine au Huduma yenyewe.

13. Sheria Tawala

Masharti haya yanasimamiwa na sheria za Jamhuri ya Kidemokrasia ya Kongo, bila kuzingatia kanuni za mgongano wa sheria, isipokuwa sheria za mahali unapoishi zihitaji vinginevyo. [Yatathibitishwa na washauri wa kisheria kabla ya kuchapishwa, hasa kuhusu watumiaji wa Tanzania.]

14. Mabadiliko ya Masharti Haya

Tunaweza kusasisha Masharti haya mara kwa mara. Tukifanya mabadiliko makubwa, tutasasisha tarehe ya "sasisho la mwisho" hapo juu na, inapofaa, kukujulisha kupitia programu. Kuendelea kutumia Huduma baada ya mabadiliko kuanza kutumika kunamaanisha kukubali Masharti yaliyosasishwa.
